GENERAL: Butterfly Creek (including respective employees, agents, officers and directors) exclude, to the fullest extent possible under law, all and any liability for any loss, damage or injury (whether direct or indirect or consequential, however arising) suffered by the Guest or any person associated with the Guest in relation to the booked activity. All activities have elements of risk and all guests undertaking any Activity do so voluntarily and at their own risk. To the extent permitted by applicable laws, all warranties, representations and implied terms are also excluded. Butterfly Creek reserves all rights to cancel any Activity at its discretion for (but not limited to) any of the following reasons: a) waterway, road or weather conditions; b) lack of numbers participating in the Activity; c) unsuitability of Guest(s) due to reasons such as intoxication or any other reasons rendering a Guest unsuitable or unfit to participate in the Activity; d) any other circumstances which are beyond the reasonable control of Butterfly Creek. All Guests agree to adhere to any instructions in relation to the Activity from Butterfly Creek at all times. These terms are subject to rights and remedies you have under the Consumer Guarantees Act 2003 GIFT CERTIFICATES: Butterfly Creek Gift Certificates should be used within the expiry date listed on the voucher. Gift Certificates that are of monetary value should be used in one transaction and on the same day. EDUCATION GROUPS & SCHOOL HOLIDAY PROGRAMMES: 1. All education visits must be weekdays and outside school and public holidays. 2. Groups must pay as a group and consist of 10 or more paying visitors (i.e. one payment). There are no exceptions for any late or unaccounted for adults, they will be charged the full price of $28.00 for entry and $3.00 for a train ride - ensure this is communicated to all parents. If they do pay separately they must mention they are with a group to receive the correct wristband. 3. All adults/teachers are responsible for the behavior of their children. You must ensure that Butterfly Creek facilities are not left in an abused or damaged condition. Any damage to Butterfly Creek property will be charged to the group who can then take the matter up with the person/s responsible. 4. Groups are seen as a ‘Special Promotion’ – no membership pass /specials coupons/vouchers can be used on a visit. 5. Valuables should not be left in the bag storage room - Butterfly Creek is not responsible for lost or stolen items. 6. Use of the picnic tables by the playground are for people who have purchased from Papillon Bar & Café. We make an exception for educational groups – children are permitted to bring their own packed lunch. We encourage healthy eating at Butterfly Creek, fast food or takeaways are not permitted to be brought in during school trips. 7. On the day your group is welcomed and will be given guidance & rules etc. from our group co-ordinator, please see our website to download rules, risk management and trip planning information. This form is to give Butterfly Creek an idea of numbers visiting on a day so we can ensure we have sufficient staff here so our enclosures and encounters run smoothly. Arrangements can be postponed or cancelled by the school without incurring a penalty. Refund policy: No refunds within 14 days of visiting unless Butterfly Creek cancels the activity due to waterway, road or weather conditions. Otherwise, refunds are granted solely at the discretion of Butterfly Creek & may incur a 5% admin fee.
